These Terms & Conditions (“Terms”) govern your access to and use of explorethese.com and any related services (the “Site”) operated by ExploreThese LLC (“ExploreThese,” “we,” “us,” “our”). By using the Site, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the Site.

Eligibility & Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.

Orders, Acceptance & Availability

Your order is an offer to buy; we may accept or decline at our discretion. We may verify information before acceptance (e.g., billing/shipping verification, fraud screening).
We may cancel or limit quantities for any order (including suspected resale, pricing/availability errors, or system issues). If we cancel after charging you, we will refund the full amount for the cancelled portion.

Pricing, Taxes & Errors

Prices, promotions, and availability can change without notice.
Despite care, errors may occur (e.g., price, description, availability). We may cancel or correct errors and will notify you; you can accept the corrected order or receive a refund.
Applicable taxes, duties, and fees are your responsibility unless stated otherwise at checkout.

Payment

We accept the payment methods displayed at checkout (e.g., major cards, PayPal). Payments are processed by third-party providers; we do not store full card numbers.
By submitting payment, you authorize us and our processors to charge the total amount (including taxes, shipping, and any adjustments you approve).

Shipping, Delivery & Risk of Loss

Processing times and estimated delivery windows are shown at checkout and/or on our Shipping page. Estimates are not guarantees; delays can occur (carrier, weather, customs, peak seasons).
Unless otherwise stated, title and risk of loss transfer to you when the order is handed to the carrier.
Some items may ship directly from third-party suppliers or warehouses. Orders with multiple items may arrive in separate packages.

Returns & Refunds

Returns are governed by our Return & Refund Policy. Please review eligibility windows, condition requirements, exclusions, and who pays return shipping.

Product Information & Content

We aim to describe products accurately; however, minor variations (color/finish, packaging, dimensions) may occur. Screen settings and manufacturing changes can affect appearance.
Third-party manufacturer warranties (if any) are the responsibility of those manufacturers.
User reviews and ratings reflect individual opinions, not our endorsements.

Promotions, Coupons & Limited Offers

Promotions may be subject to additional terms (validity dates, exclusions, one use per customer, minimum spend). Promotions are not redeemable for cash and may not be combined unless stated.

Status messages and estimated dates are not guarantees.
Tracking updates may take 24 to 48 hours after dispatch.
Scans may not appear daily while parcels move between hubs.
Carriers and customs are outside our control.
If your order is more than seven days beyond the outer limit of the delivery estimate, you should contact Support so we can investigate with the carrier.

Electronic Communications

By placing an order, creating an account, or contacting us, you consent to:

Receive service-related emails, including order confirmations, shipping notices, and responses from Support.
Receive marketing communications only with your consent or as permitted by law.
Unsubscribe from marketing emails at any time via the link in any message.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EXPLORETHESE AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS/REVENUE/GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE IN THE 12 MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold ExploreThese harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the Site.

Governing Law & Venue

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Alabama for any dispute not subject to informal resolution. (Nothing prevents either party from seeking injunctive relief where appropriate.)

Changes to the Site or Terms

We may update the Site or these Terms at any time. Material changes will be posted with a new “Last updated” date. Continued use of the Site after changes constitutes acceptance.

Miscellaneous

Severability: If any provision is unenforceable, the remaining provisions remain in effect.
No Waiver: Our failure to enforce a provision is not a waiver.
Assignment: You may not assign these Terms without our consent; we may assign as part of a merger or sale.
Entire Agreement: These Terms plus the policies referenced (Privacy, Shipping, Returns, Payments, FAQ) constitute the entire agreement between you and ExploreThese regarding the Site.
